Nebraska Online Sports Betting Vote Draws $20.8 Million from DraftKings and FanDuel

Nebraska online sports betting could become legal following a statewide vote on November 3, 2026.

Major sportsbook operators DraftKings and FanDuel are spending millions to support the proposed changes.

Both companies have contributed $10.4 million each to Tax Relief Nebraska, a campaign supporting mobile sports betting legalization.

Together, their contributions total $20.8 million.

According to the Nebraska Examiner, Tax Relief Nebraska had raised nearly $22.5 million by October 29.

Other gaming companies, including Fanatics and BetMGM, have also contributed to the campaign.

However, the proposal has sparked debate about gambling addiction, tax benefits, and political campaign spending.

Why Is Nebraska Considering Online Sports Betting?

Nebraska already allows legal sports betting, but there are restrictions.

Currently, customers must visit licensed racetrack casinos to place sports wagers.

Mobile sports betting outside these locations is not permitted.

Supporters argue that these restrictions encourage residents to travel to neighboring states, including Iowa, where mobile betting is legal.

They believe Nebraska is losing potential tax revenue because residents can place bets elsewhere.

The proposed changes would allow eligible customers to place sports wagers through licensed online platforms while physically located in Nebraska.

However, voters must approve two separate measures before the state can introduce the new system.

Two Nebraska Sports Betting Ballot Measures Explained

The November 3 election includes two important proposals: Initiative 440 and Initiative 441.

Both measures must pass to establish the proposed online sports betting system.

Initiative 440: Legalizing Mobile Sports Betting

Initiative 440 proposes a constitutional amendment allowing online sports wagering in Nebraska.

If approved, licensed operators could offer internet-based sports betting through partnerships with authorized racetrack casinos.

This would allow customers to place wagers using smartphones and other internet-connected devices within state borders.

However, approval would not immediately launch mobile sportsbooks. Additional regulatory steps would still be required.

Initiative 441: Regulating Online Sports Betting

Initiative 441 focuses on establishing rules for the proposed market.

Under this measure, the Nebraska Racing and Gaming Commission would oversee online sports wagering.

The commission would need to adopt regulations by June 1, 2027.

The proposed framework could allow as many as 12 online sportsbook platforms.

These operators would work through licensed Nebraska racetrack casinos.

The regulations would cover licensing, taxation, and other requirements for legal sportsbook operations.

How Would Nebraska Online Sports Betting Taxes Work?

Property tax relief is one of the main arguments presented by supporters of legalization.

Under the proposal, 70% of online sports betting tax revenue would go into a state property tax relief fund.

This would follow the approach already used for certain casino gaming taxes in Nebraska.

Supporters believe legal online betting could provide additional revenue that might otherwise go to neighboring states.

Campaign sponsor Jordan McGrain has also argued that regulation could improve consumer protections.

However, opponents question how much financial relief residents would actually receive.

They argue that potential tax benefits should be weighed against the social costs of making sports betting more widely available.

The actual amount of future tax revenue would depend on factors such as betting activity, operator performance, and market participation.

Why Are Some Groups Opposing Mobile Sports Betting?

Not everyone supports the proposed expansion of sports wagering.

Save Nebraska Sports is one of the main groups opposing the ballot measures.

The organization has received support from former Nebraska Cornhuskers football coach Tom Osborne and several other current and former athletes and coaches.

Opponents have raised concerns about the potential effects of mobile gambling.

Their main concerns include:

  • Increased access to gambling throughout the day
  • Greater exposure to sportsbook advertising
  • Potential gambling addiction and financial harm
  • Harassment directed at college athletes
  • Uncertainty about the scale of property tax benefits

Critics argue that allowing people to gamble from smartphones could make it harder for some individuals to control their betting.

Supporters, meanwhile, believe that a regulated market could introduce oversight and consumer safeguards.

These competing arguments remain central to the November 3 vote.

$750,000 Campaign Donation Creates Political Controversy

The sports betting campaign has also attracted attention over political contributions.

On October 27, Tax Relief Nebraska donated $750,000 to Tim Anderson, a Republican candidate running for Nebraska’s Legislative District 38.

According to News Channel Nebraska, Anderson’s campaign had raised approximately $95,000 before receiving the contribution.

The payment became a major issue in the final days before the election.

Three prominent Republican officials withdrew their endorsements of Anderson:

  • US Senator Pete Ricketts
  • Nebraska State Treasurer Joey Spellerberg
  • Nebraska State Auditor Mike Foley

Their decisions followed concerns about Anderson’s connection to the online sports betting campaign.

New advertisements supporting mobile sports wagering have also appeared under Anderson’s name.

Why Did the Donation Attract Attention?

Nebraska political candidates can purchase certain advertisements at lower rates than ballot-measure committees.

This difference has raised questions about how campaigns use political advertising rules.

Earlier in 2026, state lawmakers declined to prohibit the practice.

The $750,000 contribution has therefore become part of a wider discussion about campaign financing and gambling industry influence.

However, the donation itself does not determine the outcome of the ballot measures.

What Happens If Nebraska Approves Online Sports Betting?

The future of Nebraska online sports betting depends on the November 3 election results.

If voters approve both Initiative 440 and Initiative 441, the state would begin establishing a regulated mobile sports wagering market.

The Nebraska Racing and Gaming Commission would then work on the necessary regulations.

Licensed racetrack casinos could partner with sportsbook operators to provide online betting services.

Companies such as DraftKings, FanDuel, BetMGM, and Fanatics could potentially seek opportunities in the state.

However, any launch would depend on regulatory approval and the final licensing framework.

If the required measures do not pass, Nebraska’s existing restrictions on mobile sports betting would remain in place.

For now, the state continues to permit sports wagers only at authorized physical locations.

Nebraska Sports Betting Election: What Comes Next?

The November 3 vote will determine whether Nebraska moves toward legal mobile sports betting.

DraftKings and FanDuel have provided most of the funding for the campaign supporting legalization.

Supporters argue that online wagering could generate additional tax revenue and provide a regulated alternative to betting in neighboring states.

Opponents remain concerned about gambling addiction, college athlete protection, and the financial impact on residents.

The controversy surrounding political donations has added another issue to the debate.

With two separate measures on the ballot, the election will determine whether Nebraska can begin developing a legal mobile sports betting market.

The results will also help shape the future of sports wagering regulation in the state.
